Acceptable Use Policy (AUP)

This document contains information about what type of behavior is and is not allowed on the Profitability.net network. If you have any questions please contact us.

This AUP is referenced in your Master Services Agreement with Profitability.net and your service may be suspended or terminated for violation of this AUP.

A Security strategy is critical to protecting your data and as a Profitability.net client you are required to take reasonable security precautions. A security exploit is potentially disruptive to Profitability.net’s network and other customers. Profitability.net may take your server, website or email off line if it is accessed or manipulated by a third party without your consent. You are solely responsible for any breaches of security affecting the servers under your control. You are also responsbile for ensuring your development team uses best practices when developing scripts and content that is uploaded to any Profitability.net shared hosting platform.

Passwords should be changed frequently and should include a mix of letters, numbers and special characters.

You may not use any Profitability.net network or service to engage in illegal, abusive or irresponsible behavior including:

-Any conduct that may result in retaliation against Profitability.net or Profitability.net clients;
-Unauthorized access to or use of data, systems or networks;
-Attempts to scan or test the vulnerability of a system or network or monitor data or traffic without express authorization of the owner of the system or network;
-Taking action which encourages or consists of any threat of harm of any kind to any person or property;
-Transmitting unsolicited commercial or bulk email, spamming, floodiing, mail bombing, or denial of service attacks on against any network or system;

You must comply with the CAN-SPAM Act of 2003 and other laws and regulations applicable to bulk or commercial email.

You agree not to infringe any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software

You may not publish or transmit via Profitability.net’s network any content that Profitability.net reasonably believes is excessively violent, incites violence, threatens violence, contains hate speech, supports terrorism, constitutes pornography; is unfair or deceptive under the consumer protection laws of any jurisdiction, is defamatory or compromises national security or creates a publich safety risk; improperly exposes trade secrets; or promotes illegal activity.

Cooperation with Investiations and Legal Proceedings

Profitability.net may, without notice to you report to the appropriate authorities any conduct by you that it believes violates criminal law and provide any information in response to a formal or informal request from a law enforcement or government entity.

Violation of AUP

Profitability.net may without notice to you suspend your service if it discovers facts that lead it to reasonably believe your services are being used in violation of this AUP or any applicable law. Profitability.net will charge $200 per hour plus the cost of equipment and materials needed to investigate, respond, remedy or repair Profitability.net network or systems for any violation of this AUP.

This AUP may be modified from time to time as reasonable to ensure adequate protection for Profitability.net officers, employees, network and systems. Profitability.net is under no responsbility to monitor customer activities and dislaims any responsibility for client misuse of the Profitability.net network or services.
